1. general

These General Terms and Conditions (GTC) apply to the sale and delivery of goods and the provision of services via the online store cookcorner.art.

Our company delivers framed or unframed photo prints to the following countries:

Austria, Germany, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Greece, Croatia, Hungary, Ireland, Italy, Lithuania, Luxembourg, Latvia, Malta, Netherlands, Poland, Portugal, Romania, Sweden, Slovenia, Slovakia.

By clicking on the checkbox in the shopping cart before placing the order "If you continue shopping, you agree to our terms and conditions and the privacy policy* ", you as the buyer agree to these terms and conditions and are bound by them.

Our range of offers is non-binding. An order placed by a customer with full legal capacity (persons over the age of 18) constitutes an offer to conclude a purchase contract. The confirmation of receipt of the order in accordance with § 10 para. 2 ECG, which is automatically sent by e-mail, does not constitute acceptance of the offer. The purchase contract is only concluded as soon as we deliver the ordered goods, by sending a separate order confirmation or by otherwise accepting the customer's offer.

All offers on our website are subject to change and non-binding.

3. order process, order correction and order cancellation

If you select a product, you can add it to your shopping cart without obligation by clicking the "Add to cart" button. You can view the contents of the shopping cart at any time by clicking on the "Add to cart" button and make changes. Products can be removed by clicking on the "Delete" button.

If you would like to complete the order, click on "Checkout" and enter your personal details, delivery address and payment information. After checking your details, complete the order process by clicking on the "Order for a fee" button.

By using the "Back" function of your browser, you can correct your entries at any time or cancel the order process by closing the browser window.

After completing the order, you will automatically receive an e-mail with the order confirmation. We save the text of the contract and send you the order confirmation by e-mail. For security reasons, your order data cannot be accessed permanently via the Internet.

4. contract language

The contract, order and business language is German. All information, customer communication, confirmations and documents are provided in German.

International addendum: In case of doubt, the German version shall prevail for translations of these GTC or other contractual documents into other languages.

5 Prices and terms of payment

All prices are quoted in euros (EUR) and include VAT at the statutory rate. The prices stated in the online store are valid at the time of ordering.

In addition to the price of the goods, shipping costs may be incurred, which are clearly shown in the shopping cart before the order is completed.

Only digital payment methods (e.g. PayPal, Stripe, credit card) are available as payment methods. The invoice amount is due immediately and will be collected upon completion of the order.

Should export or import duties become due in the course of shipment (e.g. for deliveries outside the EU), these shall be borne by the customer.

6. right of withdrawal

Right of withdrawal
Consumers have the right to withdraw from the purchase contract for a print from cookcorner within 14 days without giving reasons.

Withdrawal period
The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

Exercising your right of withdrawal
To exercise your right of withdrawal, you must inform cookcorner(info@cookscorner.art, Unterauer Straße 75, 3370 Ybbs an der Donau) of your decision by means of a clear statement (e.g. e-mail or letter). You can voluntarily use the attached sample withdrawal form.

To meet the withdrawal deadline, it is sufficient for the notification of the exercise of the right of withdrawal to be sent before the deadline expires.

Consequences of withdrawal
If you withdraw from the contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs incurred if you have chosen a delivery method other than standard delivery), immediately and at the latest within 14 days of receipt of the withdrawal. For the refund, we will use the same means of payment that you used for the original transaction.

You must return the received goods to cookscorner immediately and at the latest within 14 days from the day on which you informed us of your revocation. The deadline is met if you send the goods in good time. The direct costs of the return shipment are borne by you as the buyer.

You only have to pay for any loss in value of the goods if this is due to handling of the goods that was not necessary to check their condition, properties and functionality.

Exceptions to the right of withdrawal

  • Prints that are individually produced according to customer specifications or are clearly tailored to your personal needs.
  • Prints whose production has already begun (e.g. printing, cutting or framing).
  • Products that are not suitable for return for reasons of hygiene or health protection, provided the packaging has been opened after delivery.

Note: You will be expressly informed before the purchase and during checkout that customized prints are excluded from the right of withdrawal. Please note this regulation before you complete the order.

7. payment

Payment via Stripe
We use the payment service provider Stripe to enable payments by credit card or debit card.

Your data is processed on the basis of Art. 6 para. 1 lit. f GDPR and for contract fulfillment in accordance with Art. 6 para. 1 lit. b GDPR.

The following personal data is transmitted to Stripe: Name, address, e-mail address, payment information (credit card/debit card) and any other information required for payment processing.

If you pay by credit card, you will be charged on the same day. You enter the following data: Cardholder, card number, credit card company, expiry date and CVV code. The data is transmitted using SSL encryption with at least 128-bit encryption.

Payment via PayPal
You can make the purchase via your PayPal account or pay by credit/debit card via the PayPal platform. If you already have a PayPal account, you can log in with your account details. If you are new to PayPal, you can create an account for free and then pay using your e-mail address and password.

Your data is processed to fulfill the contract in accordance with Art. 6 para. 1 lit. b GDPR and on the basis of our legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR.

8. default of payment

If the customer is in default of payment, we are entitled to demand the statutory default interest. The statutory default interest between consumers and entrepreneurs is 4 percentage points.

9. reminder and collection charges

In the event of default, the contractual partner undertakes to reimburse us for the dunning and collection expenses to which we are entitled, even in the event of default in payment through no fault of our own, insofar as they are necessary for appropriate legal prosecution and are reasonable in relation to the claim. In particular, he undertakes to bear the costs incurred by us in the event that a debt collection agency is called in, insofar as these do not exceed the maximum rates due to debt collection agencies.

10. reservation of title

We reserve title to the delivered goods or to the media processed or created by us until all payments arising from the business relationship with the customer have been received. If the customer resells goods subject to retention of title, he must also pass on the retention of title. The customer must notify us immediately of any seizure by third parties of our goods subject to retention of title.

Pledges, transfers by way of security and similar of the goods subject to retention of title are only permitted with our prior consent. If payment is not made immediately after a reminder, our goods subject to retention of title must be returned immediately. The return costs shall be borne by the customer.

11. data protection

The protection of your personal data is of particular concern to us. We process your data exclusively on the basis of the statutory provisions (GDPR, TKG 2003). In this data protection information, we inform you about the most important aspects of data processing on our website.

Processing of data (customer and contract data)
cookscorner collects, processes and uses your personal data only insofar as it is necessary for the establishment, content or modification of the legal relationship (inventory data). This is done on the basis of Art. 6 para. 1 lit. b GDPR. cookscorner only collects personal data about the use of our website (usage data) insofar as this is necessary to enable you to use the service or to bill you for it. Your data will be deleted after termination of the business relationship. Statutory retention periods remain unaffected.

What data is processed and stored?
cookscorner would like to point out that the following data is processed and stored in the context of cookies for the purpose of simplifying the purchasing process and for subsequent contract processing:

  • IP data of the subscriber
  • Name
  • Address
  • E-mail address
  • Phone number
  • Order information
  • Payment method

The data you provide is required to fulfill the contract. We cannot conclude the contract with you without this data. Data is only transferred to third parties in the context of payment processing, shipping, production and our tax obligations.

Disclosure of data to third parties
In order to fulfill our contractual obligations and to process your order properly, we disclose personal data to third parties in the following cases:

  • Payment processing: Transmission of your payment data to PayPal, Stripe or other providers exclusively for the purpose of payment processing.
  • Shipping: Forwarding of name, delivery address and, if applicable, telephone number to shipping service providers (e.g. Post, DPD, DHL).
  • Print & Fulfillment: Transmission of your order information to the print shop/fulfillment partner for the production and shipment of your product.

All third-party providers are contractually obliged to use your data exclusively for the provision of the respective service and not to pass it on to unauthorized third parties.

Purposes of data processing
cookscorner processes your personal data for the following purposes:

  • to process your order
  • to provide and improve the website
  • for the detection and prevention of abuse
  • to answer inquiries

Legal basis for data processing: our legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR to fulfill the stated purposes.

SSL encryption
This site uses SSL encryption for security reasons. You can recognize an encrypted connection by "https://" and the lock symbol in the browser.

Cookies
This website uses cookies to make the website more user-friendly. We use:

  • Session cookies (are deleted after the visit)
  • Persistent cookies (recognize your browser on subsequent visits)

You can deactivate cookies in the browser settings; this may limit the functionality.

Server log files
When you visit our website, information such as IP address, browser type, operating system and time is automatically recorded and stored for 14 days. This information is not merged with other data.

Google Analytics 4
This website only uses Google Analytics 4 with your consent (opt-in). No IP addresses are stored. The data is used to analyze and improve our offer. You can withdraw your consent at any time.

12 Guarantee, warranty and liability

We want you to enjoy your cookcorner print for a long time. That's why, in addition to your statutory warranty claims, you also receive a voluntary guarantee on all our framed and unframed works.

Our print material
All prints are printed as standard on ILFORD Galerie Smooth Pearl - a 330 g, pearlescent art paper. This paper is known for its brilliant color reproduction, high level of detail and elegant appearance. To ensure that your print retains its quality, you should handle it with care:

  • If possible, do not touch the motif surface with your fingers, as this can lead to visible marks or damage.
  • Do not store the print in damp rooms and do not expose it to direct sunlight.

Voluntary guarantee
Our voluntary guarantee applies to production or material defects as well as verifiable transport damage. It is claimed from the manufacturer or guarantor (Cyberlab Digitale Entwicklungen GmbH). We will cover the costs of return shipment in the event of a warranty claim via a return label. The warranty is limited to the value of the print.

Statutory warranty
The statutory warranty is based on the statutory provisions and is 24 months from acceptance of the goods.

  • In the event of justified complaints, you are entitled to free repair or replacement.
  • If this is not possible or unreasonable, you are entitled to a price reduction or, if the defect is not minor, to termination of the contract.

If possible, defects should be reported upon delivery or immediately after discovery. In B2B transactions, the goods must be inspected within 2 weeks of receipt and a defect must be reported immediately. Failure to report defects in the case of consumers does not affect the warranty claims.

Liability
cookcorner is only liable in cases of intent or gross negligence. The statutory provisions apply to personal injury and consumer transactions. Compensation for consequential damage, other property damage, financial loss or damage to third parties is excluded, unless it is a consumer transaction.

Transfer of risk during shipping
In the case of consumer transactions, the risk of loss of or damage to the goods shall only pass to you as soon as the goods are delivered to you or to a third party designated by you, other than the carrier. If you conclude the contract of carriage yourself without using our suggested selection, the risk shall pass to you as soon as the goods are handed over to the carrier.

13 Applicable law & place of jurisdiction

Austrian law shall apply. For consumers the place of jurisdiction is the place of residence, for companies our registered office.
